Criteria for Registration Qualification

In compliance with the provisions of article 92, literal h), of the Regulations of the Industrial Property Law, Government Agreement number 89-2002, regarding the attribution of the Intellectual Property Registrar to issue a guide of criteria related to his activities, this document is issued which contains a guide of the criteria to be applied in the procedures related to the Department of Trademarks and Distinctive Signs of this Registry.

This guide is a tool designed to ensure the effective protection of intellectual property rights, providing legal certainty, transparency, and fairness within the intellectual property system in Guatemala. Its main objective is to offer users of the Intellectual Property Registry and the examining attorneys of the Trademark Department a detailed reference on the practices and procedures for processing trademark registration applications, as well as the Registry's approach to examining such applications.

TRADEMARKS AND DISTINCTIVE SIGNS

In compliance with the provisions of the current regulatory framework on copyright and related rights, and taking into account the authority of the Intellectual Property Registry to issue guidelines that direct its administrative actions, the Guide to Copyright and Related Rights is presented.


This document brings together the criteria and procedures applicable to the management of the registration of works, acts and contracts in copyright matters, as well as the related rights of performing artists, phonogram producers and broadcasting organizations.


This guide aims to provide legal certainty, transparency, and uniformity in the administrative processes related to the Department of Copyright and Related Rights. It also serves as a reference tool for both Registry users and examiners, detailing the practices, requirements, and criteria adopted by this Institution for analyzing applications, issuing certificates, and other related actions.


Its main purpose is to facilitate an adequate understanding of the system for protecting works and protected performances, promoting a clear, accessible and efficient exercise of intellectual property rights in Guatemala.
